Protection from HIPAA Exposure for Social Service Organizations

The Health Insurance Portability and Accountability Act (HIPAA) rules also apply to businesses, such as the social services organizations referenced below. They are required to comply with HIPAA stipulations in order to conserve their patients’ privacy rights and secure health information. Unfortunately, there are instances when these HIPAA rules are violated and a mistake is made, which may lead to a claim filed against the insured’s business.

As a specialist insuring a wide range of human & social services, it is crucial for AFC Insurance to comprehend the exposures involved with each class of business to efficiently and adequately provide the necessary coverages. The majority of eligible risks for our Human & Social Services Insurance Program share the same exposures as their operations involve the management of patient and client files, records, and private information.

Some of these eligible risks include, but are not limited to, Adult Day Care Centers, Addiction Treatment Centers, Hospice Agencies, Mental Health Facilities, HIV/AIDS Services, Intermediate Care Facilities, Respite Care and Traumatic Brain Injury.

Within our Human & Social Services Insurance Program, our insureds may be offered the Limited Health Insurance Portability and Accountability Act Coverage Form endorsement to protect them from the HIPAA exposure. This endorsement provides coverage for defense and damages.

The program may also offer an extension endorsement to the Commercial General Liability form within AFC’s Human & Social Services Insurance Program. The Limited Health Insurance Portability and Accountability Act (HIPAA) Coverage Extension Endorsement is sub-limited to $50,000 and is offered at no additional premium*.
